Sjöcrona . van Stigt Advocaten

Sjöcrona • Van Stigt advises the client on how to prevent or resolve criminal law issues

Advice or litigation? Our expertise in both areas is highly-praised

Corporate criminal law is part of our core business. We handle financial, economic, environmental and tax crime cases on a daily basis, for companies and their management. We have also got specialists for criminal cases of a more general nature.

Often, criminal law evokes an image of an advocate, defending his client in open court. Of course, we do regularly appear in court sessions, advising and assisting our clients. Forcefully where necessary. Subtly where possible. Together with the client, we will thoroughly prepare for these court sessions.

In complicated criminal cases, touching on tax, civil or administrative law, we work together with advocates or tax specialists from renowned firms, both at home and abroad.

But in our practice, it does not always actually come to a trial. Not every case in which a client has drawn police or judicial attention leads to the involvement of a judge. Thorough legal assistance by specialized criminal advocates at an early stage may result in the client not being indicted.

So every day, we advise companies and individuals on how to anticipate possible (or apparent) police or judicial attention. In the preparation for contacts with, for instance, FIOD-ECD (Fiscal Investigation and Information Service-Economic Investigation Service) or the Prosecution Service, we always practice the interrogations with our clients. The right answer during an interview may be the difference between conviction or acquittal.

And we increasingly advise clients who do not yet have any criminal law-related problems whatsoever and prefer to keep it that way. In doing so, we prevent the risks of criminal liability. We, for instance, assist companies in drafting internal corporate guidelines ensuring proper Corporate Governance. In case of intended takeovers, we may also be part of a team of lawyers, notaries public, tax and other specialists, in order to advise on latent criminal pitfalls.
