
Liability for involuntary accidents or disasters (collapses/explosions/fires) is no longer solely considered a matter of civil law. Increasingly, criminal law is applied in order to achieve successful prosecution for, for instance, criminally negligent manslaughter . Over the past years, a team of advocates from our firm has worked on a number of such cases, with success.
The Working Conditions Act contains many clauses – mainly directed towards 'employers' -, aiming to increase safety at work. Acting in violation of that Act is prohibited should the employer know or reasonably have known that this could endanger the life or cause serious damage to the health of employees. Our advocates have an outstanding track record in advising employers during the investigation phase, for instance in preparing for interrogations by the Labour Inspectorate. We also regularly assist employers who have to appear in court for violation of the Working Conditions Act.
